ALIWA RESISTE

Dear President of the Inter-American Commission on Human Rights.

I %first_name% %last_name% would like to request from the Honorable Inter American Commission on Human Rights a decision regarding the case : “Solicitud de Medidas Cauterales ; Caso de las comunidades indígenas Sikuani de Aliwa-Cupepe, en el Estado de Colombia”

On November 2018, the Gobierno Mayor Autoridades Tradicionales Indígenas de Colombia, with our support and the collaboration of the Legal Clinic on Human Rights of the university Aix-en-Provence (France), sent to your commission a request for precautionary measures regarding the indigenous and human rights violations that are affecting the Sikuani indigenous peoples of the communities of Aliwa Cupepe.

At this date, we still haven’t received any news regarding these precautionary measures.

Consequently, we demand that the commission and the Colombian government notify us on the status of the petition in which we requested the following precautionary measures:

  1. Enact measures that are culturally appropriate, aimed to protect the Right to Life and the physical integrity, in the cases of threats, attacks or acts of violence, of the members of the Sikuani communities of the ancestral territory of Aliwa-Cupepe.

  2. Suspend the actions of the public force in the territories that are awaiting constitution of Resguardo (Aliwa Cupepe):

• Until the process of constitution of indigenous resguardo is finished.

• Until it is proven, through these precautionary measures, that the indigenous Sikuani communities have benefited from their collective right to the lands of Aliwa Cupepe.

  1. The immediate implementation of the first section of the second order of the T-009 sentence emitted in 2013 by Colombia’s constitutional court.

  2. The immediate implementation of the second section of the second order of the T-009 sentence emitted in 2013 by Colombia’s constitutional court.

  3. The immediate implementation of the T-009 sentence emitted in 2013 by Colombia’s constitutional court.

  4. That the Colombian state strengthens its strategy for the eradication of coca cultivation, and the destruction of the laboratories located on the indigenous territory of Aliwa Cupepe, which have caused immense damages to the ancestral land of Aliwa, and to the survival of the Sikuani communities who live there.

  5. That the Colombian state take the necessary measures to protect the life of the indigenous leader Reinaldo Rincón Nariño, and ensure his safe return to his community.

  6. That the Colombian state take the necessary measures to guarantee the right to health and physical integrity of all the inhabitants of the ancestral territory of Aliwa Cupepe.

We are at your disposal for any further information you need.

We thank you for your help in guaranteeing the conditions for a dignified life in the ancestral land of Aliwa Cupepe.

Cordially,
